Welcome to our website. This website is owned and operated by FW Pymble Pty Ltd (ABN: 88 136 977 441), successors and assignees, (we or us). It is available at: www.myidealwedding.com.au (Site) and may be available through other addresses or channels.

My Ideal Wedding is not a wedding product supplier or a wedding vendor. My Ideal Wedding has members who are sourcing services and goods from suppliers associated with the Wedding Industry. My Ideal Wedding facilitates the interaction between members and suppliers and as such has no control over the accuracy or quality of transactions, listings, services or products. Members should refer to the Terms and Conditions of the third party supplier with whom they are engaging.

These Terms of Use (Terms) govern your use of our Site and form a contract between you and us if you use the Site. Please read these Terms carefully. Your use of the Site indicates that you have had sufficient opportunity to access the Terms and that you have read and accept the Terms.

1. Information: The information, including statements, opinions and documents contained in this Site (Information) is for general information purposes only. Any reliance you place on the Information is at your own risk.
2. Amendment: The Information and Terms may be amended without notice from time to time in our sole discretion. Your use of our Site following any amendments indicates that you accept the amendments.
3. Your warranties: You warrant to us that you have the legal capacity to enter these Terms and form a contract, and that you have read and understood the Terms, before using the Site.
4. License to use the Site: We grant you a non-exclusive, royalty-free, revocable, worldwide, non-transferable right and licence to use the Site for your personal, non-commercial use, in accordance with the Terms. All other uses are prohibited without our prior written consent. We reserve the right to reject a membership or listing with no obligation to provide reasons for so doing. Furthermore we maintain the right to amend or remove a membership or listing .
5. Fees: The following sets out any fees which may be applicable to users of this site. Fees are exclusive of GST.
   1. Members-Members can use the site free of charge. This includes all facilities including search functions and planning tools.
   2. Vendors-There will be a sliding scale of fees for vendors. Subscription fees will be as detailed on the site. We reserve the right to amend fees at any time and also to offer discounted or promotional rates at any time.Subscription fees are charged periodically in advance. Vendors can choose to pay monthly, quarterly, six monthly or annually. Subscriptions are automatically renewed on the relative anniversary of the initial signup unless the Auto renew function has been disabled on the advertisement by the vendor. Once payment has been made vendors will have access to load their advertisements. As soon as the advertisements have been loaded they will be available on the website. Refunds will not be issued.    3. Non-Payment of Fees-Should payment not be received as required we reserve the right to remove your advertisement from the website pending the receipt of the specified fees. We further reserve the right to take legal actions to recover monies owed and furthermore recover all costs related to the recovery of monies owed.
6. Reviews:

   Vendors understand an integral part of the site is the ability for Members / Customers to post reviews for vendors on the site.

   Upon receipt of such reviews a copy will be forwarded to the applicable vendor with advice on the date that the review will be posted- generally within 7 days of receipt. The vendor will then have the opportunity to add a comment prior to the review being posted.

   Reviews can only be posted by Members who have conducted business with the Vendor concerned. If requested the Member will need to provide evidence of that business. Members placing reviews must provide their full name and details of when the service or product was provided.

   We retain the right to audit any reviews. Whilst the reviews are being audited they may be removed temporarily or permanently. The audit process may require contact with the reviewer. If contact cannot be made with the reviewer the review may not be posted.

   We maintain the right to make the final decision on whether a review will or will not be posted.

   My Ideal Weddings will not comment on any goods or services provided and will not be held liable for any loss or damage caused by such reviews.

7. Prohibited Conduct: You must not:
   1. Use the Site for any activities, or to post or transmit any material from the Site unless you hold all necessary rights, licences and consents to do so;
      • that infringes the intellectual property or other rights of any person;
      • that would cause you or us to breach any law, regulation, rule, code or other legal obligation;
      • that defames, harasses, threatens, menaces, offends or restricts any person;
      • that is or could reasonably be considered to be obscene, inappropriate, defamatory, disparaging, indecent, seditious, offensive, pornographic, threatening, abusive, liable to incite racial hatred, discriminatory, blasphemous, in breach of confidence or in breach of privacy; or
      • that would bring us, or the Site, into disrepute.
   2. Interfere with or inhibit any user from using the Site;
   3. Use the Site to send unsolicited email messages;
   4. Attempt to or tamper with, hinder or modify the Site, knowingly transmit viruses or other disabling features, or damage or interfere with the Site, including but not limited to the use of trojan horses, viruses, or piracy or programming routines that may damage or interfere with the Site; or

8. Copyright and Intellectual Property Rights:

   Our Site contains material which is owned by or licensed to us and is protected by Australian and international laws, including but not limited to the trademarks, trade names, software, content, design, images, graphics, layout, appearance, layout and look of our Site. We own the copyright which subsists in all creative and literary works displayed on the Site.

   You agree that, as between you and us, we own all intellectual property rights in the Site, and that nothing in these Terms constitutes a transfer of any intellectual property ownership rights.

   You must not breach copyright or intellectual property rights, including but not limited to, that you must not:

   1. alter or modify any of the code or the material on the Site;
   2. cause any of the material on the Site to be framed or embedded in another website;
   3. create derivative works from the content of the Site; or
   4. use our Site for commercial purposes.
9. Privacy: We are committed to protecting your privacy. Please read our Privacy Policy, available on our Site. By agreeing to the Terms, you agree to accept our Privacy Policy.
10. Your content:If you choose to add any content on the Site, you:
    1. warrant to us that you have all necessary rights to post the content;
    2. grant us a perpetual, non-exclusive, royalty-free, irrevocable, worldwide and transferable right and licence to use that content in any way; and

13. Security Policy:

    My Ideal Wedding offers vendors the use of the eWAY Payment Gateway for its online credit card transactions. eWAY processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet.

    All online credit card transactions performed on this site using the eWAY gateway are secured payments.

    - Payments are fully automated with an immediate response

    - Your complete credit card number cannot be viewed by My Ideal Wedding or any outside party.

    - All transactions are performed under 128 Bit SSL Certificate

    - All transaction data is encrypted for storage within eWAY’s bank-grade data centre, further protecting your credit card data.

    - eWAY is an authorised third party processor for all major Australian banks.

    - eWAY at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by My Ideal Wedding.

14. Reservation of Rights: We reserve the right to amend or delete any and all of your content, Third Party Information and/or Third Party Sites, and to block any user, if we believe that there is a violation of these Terms, or for any other reason, in our sole discretion.
15. Delays and outages: We are not responsible for any delays or interruptions to the Site. We cannot warrant that the Site will be available at all times or at any given time. We may at any time and without notice to you, discontinue the Site in whole or in part. We are not responsible for any loss, cost, damage or liability that may result from our discontinuance of the Site.
16. Limitation of Liability:

    To the extent permitted by law, we exclude all liability for any loss or damage suffered by you or any third party, or claims made against you or any third party which result from any use or access of, or any inability to use or access the Site.

    To the extent permitted by law, we exclude all representations, guarantees, warranties or terms (whether express or implied) other than those expressly set out in these Terms, and the Australian Consumer Law to the extent applicable.

23. Disputes: You agree to use your best endeavours to use mediation and negotiation to resolve any dispute arising out of or relating to these Terms, prior to resorting to an external dispute resolution process. Please notify us in writing of any dispute you may have.
24. Jurisdiction: Your use of this Site and any dispute arising out of your use of it is subject to the laws of Victoria, Australia. You irrevocably and unconditionally submit to the jurisdiction of the Courts of Victoria for determining any dispute concerning the Terms.
25. General: If a provision of these Terms are invalid or unenforceable it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions. If we do not act in relation to a breach by you of these Terms, this does not waive our right to act with respect to that or subsequent or similar breaches.
